L\u00e1, o caso rendeu processo que ainda n\u00e3o teve defini\u00e7\u00e3o na Justi\u00e7a. Mas, esta semana, um tribunal de Munique (Alemanha) decidiu contra a fabricante chinesa.<\/p>\n<p>E o que os dois casos t\u00eam em comum? Ambos se referem ao uso indevido da\u00a0<a href=\"https:\/\/www.hometheater.com.br\/portal\/2018\/01\/09\/paineis-quantum-dots-chegaram-para-salvar-tecnologia-lcd\/\"><strong>tecnologia QLED<\/strong><\/a>. Se, nos EUA, a den\u00fancia partiu de uma pessoa f\u00edsica, na Alemanha foi um concorrente (a Samsung) quem levou o caso \u00e0 Justi\u00e7a. Como se sabe, a coreana foi a primeira a lan\u00e7ar TVs com painel de pontos qu\u00e2nticos, ainda em 2017. Na \u00e9poca, obteve apoio das chinesas TCL e Hisense para formar a QD Alliance, cons\u00f3rcio que visava promover essa tecnologia.<\/p><div class=\"homet-conteudo\" style=\"text-align: center;\" id=\"homet-2439884267\"><div data-cfpa=\"36066\" data-cfpw=\"36066\" id=\"homet-1438960717\"><a data-no-instant=\"1\" href=\"https:\/\/loja.sommaior.com.br\/\" rel=\"noopener\" class=\"a2t-link\" aria-label=\"ABBEY-ROAD_360x300px\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.hometheater.com.br\/portal\/wp-content\/uploads\/2025\/10\/ABBEY-ROAD_360x300px.jpg\" alt=\"\"  class=\"no-lazyload\" width=\"300\" height=\"250\"   \/><\/a><\/div><script type=\"text\/javascript\">;new advadsCfpAd( 36066 );<\/script><\/div>\n<p>A alian\u00e7a desapareceu em 2020, quando a TCL decidiu lan\u00e7ar uma linha de TVs com a marca QLED, s\u00f3 que com outro tipo de painel. N\u00e3o deu outra: a mistura de marcas causou confus\u00e3o no mercado, chegando ao \u00e1pice em 2024, quando come\u00e7aram a aparecer em f\u00f3runs da internet coment\u00e1rios nada simp\u00e1ticos \u00e0s marcas chinesas.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>\u201cPropaganda enganosa\u201d?<\/strong><\/p>\n<p>Em abril do ano passado, a Samsung decidiu ent\u00e3o processar a TCL na Alemanha, com base numa \u201clei de concorr\u00eancia desleal\u201d. Algumas TVs QLED da chinesa, alegava a coreana, n\u00e3o utilizam os verdadeiros pain\u00e9is de pontos qu\u00e2nticos, configurando \u201cpropaganda enganosa\u201d. Agora, a Justi\u00e7a alem\u00e3 deu ganho de causa \u00e0 Samsung (ainda cabe recurso).<\/p>\n<p>Segundo o site coreano\u00a0<a href=\"https:\/\/www.thelec.net\/news\/articleView.html?idxno=5692\"><strong>The Elec<\/strong><\/a>, que cobre os bastidores da ind\u00fastria eletr\u00f4nica na \u00c1sia, a corte alem\u00e3 concluiu que o painel da TCL utiliza apenas uma \u201cpequena quantidade\u201d de pontos qu\u00e2nticos,\u00a0 insuficiente para melhorar a reprodu\u00e7\u00e3o de cores como os pain\u00e9is verdadeiros.<\/p>\n<p>A decis\u00e3o se baseou em normas da\u00a0<a href=\"https:\/\/www.iec.ch\/homepage\"><strong>IEC<\/strong><\/a>\u00a0(<em>International Electrotechnical Commission<\/em>), que define QLED como \u201caplica\u00e7\u00e3o de uma pel\u00edcula de pontos qu\u00e2nticos entre o painel LCD e o backlight\u201d.
