Com a ado\u00e7\u00e3o desenfreada da IA para comandar esses aparelhos, emissoras e produtoras de conte\u00fado come\u00e7am a se dar conta de que est\u00e3o perdendo o controle sobre o que produzem e exibem.<\/p>\n<p>Assim como os apps do streaming e os mecanismos de busca, como Google e Bing, as TVs smart e os assistentes de voz s\u00e3o hoje comandados por algoritmos. Uma de suas fun\u00e7\u00f5es e coletar dados dos usu\u00e1rios para uso de quem controla as ferramentas de IA. Uma carta divulgada na semana passada pela poderosa\u00a0<a href=\"https:\/\/www.acte.be\/\"><strong>ACT<\/strong><\/a>\u00a0(<em>Association of Commercial Television and Video on Demand Services in Europe<\/em>) utiliza termos fortes para definir a situa\u00e7\u00e3o: os OS das smart TVs (Android, Google, Amazon Fire, Samsung Tizen etc.) devem ser regulados com o mesmo rigor dos servi\u00e7os de streaming!<\/p>\n<p>A carta \u2013\u00a0<a href=\"https:\/\/www.acte.be\/publication\/european-broadcasting-associations-statement-on-connected-tvs-virtual-assistants\/\"><strong>aqui, a \u00edntegra, em ingl\u00eas<\/strong><\/a>\u00a0\u2013 foi endere\u00e7ada \u00e0 Comiss\u00e3o Europeia (CE), que vem assumindo posi\u00e7\u00f5es frontalmente contr\u00e1rias \u00e0s plataformas, mas nesse caso at\u00e9 agora n\u00e3o se manifestou. A ACT \u00e9 poderosa porque representa as principais redes de TV no continente, al\u00e9m de ter entre seus filiados marcas de peso como Disney, Paramount, Universal e Warner.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"text-decoration: underline;\"><strong>Dando nome as respons\u00e1veis<\/strong><\/span><\/h3>\n<p>O texto se apoia na chamada Lei dos Mercados Digitais (DMA, na sigla em ing\u00eas), aprovada pela Uni\u00e3o Europeia em 2022, que definiu as big techs como\u00a0<em>gatekeepers<\/em>, ou seja, respons\u00e1veis por todos os conte\u00fados veiculados em suas plataformas. Nominalmente:<\/p>\n<p><strong>*Alphabet<\/strong>\u00a0(YouTube, Android, Chrome e todos os servi\u00e7os que utilizam a marca Google, incluindo o mecanismo de buscas);<\/p>\n<p><strong>*Apple<\/strong>\u00a0(iOS, Safari, App Store);<\/p>\n<p><strong>*Meta<\/strong>\u00a0(Facebook, Instagram, WhatsApp, Messenger);<\/p>\n<p><strong>*Amazon<\/strong>\u00a0(todos os servi\u00e7os associados ao market place);<\/p>\n<p>*<strong>Microsoft<\/strong>\u00a0(Windows, LinkedIn);<\/p>\n<p><strong>*TikTok<\/strong>\u00a0(ByteDance).<\/p>\n<p>Em 2024, todas essas empresas passaram a ser obrigadas a cumprir as normas da DMA, com penas previstas de 10% sobre o faturamento global (20% na reincid\u00eancia) e, em caso extremo, desmembramento. A primeira puni\u00e7\u00e3o, naquele mesmo ano, veio para a Apple: 1,8 bilh\u00e3o de euros por impedir que fornecedores como o Spotify oferecessem op\u00e7\u00f5es de assinatura fora da App Store.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"text-decoration: underline;\"><strong>Conte\u00fado n\u00e3o \u00e9 mais rei\u2026<\/strong><\/span><\/h3>\n<p>Como se v\u00ea, a CE n\u00e3o est\u00e1 para brincadeiras nessa quest\u00e3o. H\u00e1 processos em andamento contra Alphabet, Meta, Amazon e a pr\u00f3pria Apple, por pr\u00e1ticas antitruste, tamb\u00e9m com base na DMA. Ao citar essa lei, a ACT pede puni\u00e7\u00f5es equivalentes para os fabricantes de TVs (no caso, Samsung e LG, que t\u00eam OS pr\u00f3prio), al\u00e9m de Google, Amazon etc.<\/p>\n<p>Vale lembrar que a DMA pro\u00edbe explicitamente pr\u00e1ticas anticompetitivas nas lojas de aplicativos, nos mecanismos de busca e at\u00e9 nas redes sociais. As emissoras pedem agora que isso seja aplicado a smart TVs e assistentes virtuais, que se tornaram meios importantes de controle do acesso aos conte\u00fados.<\/p>\n<p>Se em 1996 Bill Gates dizia que \u201co conte\u00fado \u00e9 rei\u201d, e os donos de conte\u00fado acreditaram, talvez seja hora de repensar esse conceito. N\u00e3o importa que tipo de conte\u00fado, os novos \u201creis\u201d s\u00e3o aqueles que dominam os meios de distribui\u00e7\u00e3o.
