{"id":29303,"date":"2023-10-11T15:44:26","date_gmt":"2023-10-11T18:44:26","guid":{"rendered":"https:\/\/www.hometheater.com.br\/portal\/?p=29303"},"modified":"2023-11-10T15:47:46","modified_gmt":"2023-11-10T18:47:46","slug":"direito-ao-conserto-agora-e-lei-mas-so-nos-eua","status":"publish","type":"post","link":"https:\/\/www.hometheater.com.br\/portal\/2023\/10\/11\/direito-ao-conserto-agora-e-lei-mas-so-nos-eua\/","title":{"rendered":"\u201cDireito ao conserto\u201d agora \u00e9 lei (mas s\u00f3 nos EUA\u2026)"},"content":{"rendered":"<p>Seguindo o exemplo de Nova York e Minnessota, a Calif\u00f3rnia tornou-se esta semana o terceiro estado americano a aprovar uma lei para o \u201cdireito ao conserto\u201d (<em>Right to Repair<\/em>). \u00a0O m\u00e9rito \u00e9 de alguns parlamentares mobilizados pelo\u00a0<a href=\"https:\/\/pirg.org\/california\/about\/\"><strong>CALPIRG<\/strong><\/a>\u00a0(<em>California Public Interest Research Group),\u00a0<\/em>entidade privada e sem fins lucrativos que advoga v\u00e1rias causas em favor da sociedade, em \u00e1reas como consumo, sa\u00fade e meio ambiente.<\/p>\n<p>Basicamente, a lei determina que os fabricantes s\u00e3o obrigados a manter pe\u00e7as e documentos de orienta\u00e7\u00e3o para o consumidor que quiser fazer o conserto de um aparelho que apresente defeito. Foi elaborada uma tabela para entrar em vigor em julho de 2024, especificando que a obriga\u00e7\u00e3o vale para todos os aparelhos eletroeletr\u00f4nicos com valor acima de 50 d\u00f3lares, que tenham sido adquiridos no estado a partir de julho do ano passado. O fabricante deve garantir o suporte por tr\u00eas anos ap\u00f3s a compra; no caso de produtos com valor acima de 100 d\u00f3lares, o prazo \u00e9 de sete anos.<\/p><div class=\"homet-conteudo\" style=\"text-align: center;\" id=\"homet-3886670321\"><div data-cfpa=\"36066\" data-cfpw=\"36066\" id=\"homet-49722435\"><a data-no-instant=\"1\" href=\"https:\/\/loja.sommaior.com.br\/\" rel=\"noopener\" class=\"a2t-link\" aria-label=\"ABBEY-ROAD_360x300px\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.hometheater.com.br\/portal\/wp-content\/uploads\/2025\/10\/ABBEY-ROAD_360x300px.jpg\" alt=\"\"  class=\"no-lazyload\" width=\"300\" height=\"250\"   \/><\/a><\/div><script type=\"text\/javascript\">;new advadsCfpAd( 36066 );<\/script><\/div>\n<p>H\u00e1 uma lista de exce\u00e7\u00f5es; consoles de videogame, acess\u00f3rios de seguran\u00e7a e equipamentos para agricultura e florestas, o que inclui fazendas e propriedades rurais. Tudo foi debatido exaustivamente desde 2017, quando a lei foi proposta, e o governo federal n\u00e3o se envolveu \u2013 nos EUA, esse tipo de legisla\u00e7\u00e3o varia de um estado para outro.<\/p>\n<p>Como se nota, a nova lei vai exatamente na m\u00e3o contr\u00e1ria \u00e0 chamada\u00a0<a href=\"https:\/\/blog.nubank.com.br\/obsolescencia-programada\/\"><strong>obsolesc\u00eancia programada<\/strong><\/a>, que sempre regeu a ind\u00fastria de bens de consumo. V\u00e1rios fabricantes foram convidados a participar dos debates (alguns se recusaram), e a senadora Susan Eggman, autora do projeto, agradeceu essa presen\u00e7a defendendo que as empresas se conscientizem. \u201c\u00c9\u00a0uma medida que, entre outras coisas, favorece o planeta: muitos aparelhos que hoje s\u00e3o descartados por qualquer defeito agora poder\u00e3o ser preservados, reduzindo a quantidade de lixo eletr\u00f4nico no planeta\u201d, disse ela.<\/p>\n<p>N\u00e3o por acaso, a Calif\u00f3rnia \u00e9 o estado americano onde esse problema \u00e9 mais grave. Estimativa do CALPIRG indica que atualmente os locais descartam nada menos do que 228kg de\u00a0<em>e-waste<\/em>\u00a0por segundo!<\/p>\n<p><strong>Como seria no Brasil?<\/strong><\/p>\n<p>No Brasil, s\u00e3o poucas as possibilidades de que uma lei como essa seja aprovada t\u00e3o cedo, apesar dos esfor\u00e7os de grupos como o\u00a0<a href=\"https:\/\/direitodereparar.com.br\/\"><strong>DireitodeReparar<\/strong><\/a>. Estamos a anos-luz da consci\u00eancia cidad\u00e3 dos americanos, que preservam o saud\u00e1vel h\u00e1bito de se unir em causas coletivas. E a lei por l\u00e1 s\u00f3 est\u00e1 sendo aprovada devido ao envolvimento de segmentos como as oficinas de assist\u00eancia t\u00e9cnica, os pequenos comerciantes de acess\u00f3rios e grupos de press\u00e3o como o CALPIRG, al\u00e9m de alguns fabricantes, entre eles a todo-poderosa Apple.<\/p>\n<p>Isso mesmo: no in\u00edcio, a dona da ma\u00e7\u00e3 condenava a iniciativa alegando que, se liberasse seus c\u00f3digos de reparo dos aparelhos para al\u00e9m de sua rede autorizada, o mercado seria dominado pelos hackers. Usu\u00e1rios da marca devem se lembrar que, anos atr\u00e1s, a Apple passou a usar no iPhone\u00a0<a href=\"https:\/\/www.tecmundo.com.br\/apple\/7901-apple-substitui-parafusos-do-iphone-4.htm\"><strong>um tipo diferente de parafuso que nenhuma chave conseguia abrir<\/strong><\/a>. Era por isso. Talvez sintonizada com as press\u00f5es dos californianos, a partir de 2021 a empresa decidiu apoiar a nova lei. Uma delas, e n\u00e3o pouco importante, \u00e9 que a ind\u00fastria em geral vive do lan\u00e7amento de novos produtos; se isso for bloqueado, muita gente vai perder o emprego. Mas esse \u00e9 apenas um dos lados da quest\u00e3o.
